1. Who We Are

Koloritoo is developed and operated by Maxence Raoux, a sole trader based in France, based on an original idea by Aurélie Evalet.

By downloading, installing, or using Koloritoo, you agree to these Terms and Conditions. If you do not agree with these Terms, please do not use the application.

Your use of Koloritoo is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

2. The Service

Koloritoo is a mobile application that allows users to transform personal photos into printable coloring pages using artificial intelligence.

To generate a coloring page, users upload a photo and spend a credit. The generated coloring page can then be saved, printed, or shared.

AI-generated results may vary and may not always meet user expectations.

3. Eligibility and Accounts

To use Koloritoo, you must:

• Be at least 16 years old, in accordance with the GDPR minimum age for digital consent.
• Provide a valid email address and verify it to access generation features.
• Maintain the security of your account credentials.

You are responsible for all activity conducted through your account.

You may not create multiple accounts to bypass credit limits, promotions, or restrictions.

4. Credits

Koloritoo uses a credit-based system.

• New accounts receive a limited number of free credits upon registration.
• Additional credits can be purchased through the Apple App Store (iOS) or Google Play Store (Android).
• One credit is consumed for each coloring page generation, regardless of the result.
• If a generation fails due to a technical error on our side, the credit will be automatically refunded.
• Credits have no cash value, are non-transferable, and cannot be exchanged for money.
• Purchased credits do not expire unless otherwise stated.

5. Purchases and Refunds

All purchases are processed through the Apple App Store or Google Play Store. We do not directly process payments.

Purchases are generally final and non-refundable, except where required by applicable law or by the platform's refund policy.

To request a refund:

• iOS users should contact Apple at: reportaproblem.apple.com
• Android users should contact Google at: play.google.com/store/account

We reserve the right to change credit pricing at any time. Price changes will not affect credits already purchased.

6. Your Content

You retain full ownership of the photos you upload and the coloring pages generated from them.

By uploading a photo, you grant Koloritoo a limited, non-exclusive license to process the image solely for the purpose of generating a coloring page and operating the service.

You are responsible for ensuring that:

• You have the legal right to upload the image
• You have obtained consent from any identifiable person in the photo

Photos of minors should only be uploaded by a parent or legal guardian.

7. Content Restrictions

You agree not to upload content that:

• Is illegal
• Contains nudity or explicit material
• Depicts violence or harmful activity
• Infringes on intellectual property rights
• Violates the Apple App Store or Google Play policies

We reserve the right to remove content or restrict accounts that violate these rules.

8. Acceptable Use

You agree not to:

• Use the service for unlawful purposes
• Attempt to reverse-engineer or exploit the app
• Use automated tools to generate images in bulk
• Abuse free credits, promotions, or system limitations

Accounts found abusing the service may be suspended or permanently terminated.

9. Availability of the Service

We aim to provide a reliable service but do not guarantee uninterrupted availability.

Koloritoo may be temporarily unavailable due to maintenance, technical issues, or external service disruptions.

We reserve the right to modify, suspend, or discontinue the service at any time.

10. Intellectual Property

The Koloritoo application, including its software, design, branding, and related assets, is the intellectual property of Maxence Raoux.

You may not copy, reproduce, distribute, or create derivative works from the app without prior written permission.

11. Disclaimer of Warranties

Koloritoo is provided "as is" and "as available".

We make no guarantees regarding the quality or accuracy of generated coloring pages, the availability of the service, or the suitability of the service for a particular purpose.

AI-generated content may produce unexpected or imperfect results.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Maxence Raoux shall not be liable for any indirect, incidental, or consequential damages resulting from the use of Koloritoo.

Our total liability for any claim arising from the service shall not exceed the total amount you paid for credits during the 12 months preceding the claim.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted with a revised "Last updated" date. Continued use of the application after changes means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of France.

Any disputes relating to these Terms or the use of Koloritoo shall be subject to the jurisdiction of the courts of France.
